By this instrument, the professional identified below, in their capacity as employee or service provider engaged by the contracting company, declares having been informed of and expressly agrees to the terms below relating to the recording and analysis of commercial interactions carried out in the exercise of their functions.

2. Subject and nature of the tool

The contracting company adopts the Glivo platform for recording, automatic transcription and AI-based analysis of the commercial interactions carried out by the professional, with the exclusive purpose of supporting professional development, learning and improvement of sales technique.

Nature of the tool — read carefully

Glivo is a coaching and professional development tool, not a monitoring, surveillance or punitive evaluation system. The analyses generated by the AI are advisory and probabilistic in nature, and do not by themselves constitute a formal performance evaluation tool for employment purposes.


3. Limits on use and worker protection

The contracting company expressly declares, and the professional acknowledges, that:

  1. The outputs of the artificial intelligence are not 100% accurate. The transcript may contain errors, and the analysis is probabilistic, subject to inaccuracies and biases inherent in automated systems.

  2. The AI’s results will not be used, in isolation, as a basis for:

    • Application of disciplinary sanctions, suspensions or other measures;
    • Dismissal with or without cause, or any termination of the employment contract;
    • Discrimination of any kind;
    • Automated decisions affecting the professional’s rights without human intervention (Art. 22 GDPR).
  3. Any employment decision involving the results generated by the platform will mandatorily be reviewed by a qualified human manager, substantiated by multiple sources of information (history, commercial indicators, context, direct observation), in accordance with applicable national labor law, the GDPR and other applicable rules.

  4. The professional has the right to human intervention in automated decisions affecting them, under Art. 22 of the GDPR, and may also express their point of view and contest the decision at any time.

  5. The recordings and transcripts do not replace due disciplinary process. Any formal feedback, action plan or disciplinary proceeding shall comply with the legislation in force and be conducted by human managers.

  6. Compliance with labor law on workplace monitoring: the contracting company declares to comply with applicable national rules on workplace monitoring and digital rights at work, having informed the professional about the existence and characteristics of the recording system and, where required, consulted workers’ representatives.


4. Information and authorization

The professional declares being fully informed that:

  1. The in-person commercial interactions they carry out may be recorded in audio.
  2. Recordings will be automatically transcribed into text.
  3. The interactions will undergo AI-based automated analysis, generating scores, indicators, comments and improvement suggestions.
  4. Personal data (names, national identification numbers, phone numbers, emails) present in the recordings are automatically anonymized in the transcripts visible to managers.
  5. The results of the analyses will be made available to managers and hierarchical superiors of the team.
  6. The data generated may be used for individual feedback, training sessions and development plans, always with human review.
  7. The raw audio has a defined retention period (default of 90 days, unless configured differently by the company), after which it is automatically deleted.

5. Authorized purposes

The professional acknowledges that the recordings and the results of the analysis will be used exclusively for the following purposes, on the basis of the employer’s legitimate interest (Art. 6(1)(f) GDPR), duly balanced:

  • ✅ Continuous evaluation of the quality of the service provided;
  • Training, capacity-building and professional development;
  • ✅ Identification of opportunities for improvement of sales technique;
  • ✅ Tracking of objectives and commercial indicators (always with human analysis);
  • ✅ Internal audit and supervision of compliance with procedures;
  • ✅ Resolution of any disputes or complaints from customers.

Prohibited purposes

The company will not use the recordings, transcripts or analyses for:

  • ❌ Surveillance or abusive monitoring;
  • ❌ Substantiating, in isolation, disciplinary sanctions, dismissals or causes for dismissal;
  • ❌ Discriminatory practices of any kind;
  • ❌ Sharing with unauthorized third parties;
  • ❌ Training of AI models external to the platform;
  • ❌ Commercial or marketing activities;
  • ❌ Public exposure of the professional.

6. Professional’s commitments

By accepting this agreement, the professional undertakes to:

  1. Ensure that the interaction takes place in an environment with the recording signage visible and follow the company’s guidance on communication to the customer.
  2. Not deactivate, circumvent, omit or hinder the recording of interactions without express manager authorization.
  3. Not share, reproduce, distribute or disclose recordings, transcripts or analysis content outside the working environment.
  4. Not use the platform for personal purposes or unrelated to professional activity.
  5. Treat with confidentiality the customer information accessed through the recordings and reports.
  6. Promptly communicate to the manager any technical failure, leak or suspicion of misuse of the recordings.
  7. Promptly respect any pause or refusal request by the customer regarding recording.

7. Professional’s rights (GDPR)

The rights of the professional regarding personal data (voice, speech, transcript, analyses) processed in the context of this platform are:

  • Access (Art. 15 GDPR): request confirmation of the existence of processing and access to data concerning them.
  • Rectification (Art. 16 GDPR): request correction of incomplete, inaccurate or out-of-date data.
  • Erasure (Art. 17 GDPR): request the deletion of specific recordings or all of their data, subject to legal retention obligations.
  • Restriction of processing (Art. 18 GDPR): restrict the processing of their data in certain situations.
  • Data portability (Art. 20 GDPR): receive their data in a structured, commonly used and machine-readable format and transmit it to another controller.
  • Objection (Art. 21 GDPR): object to processing based on legitimate interest.
  • Not to be subject to automated decisions (Art. 22 GDPR): right to human intervention, to express their point of view and to contest decisions.
  • Lodge a complaint with the supervisory authority (Art. 77 GDPR): lodge a complaint with the competent supervisory authority of their EU/EEA Member State.
  • Manifestation to the DPO: lodge a manifestation with the company’s Data Protection Officer.

How to exercise your rights: send a written request to the local point of contact of the unit or to the company’s Data Protection Officer (DPO). The response will be provided within the legal time frame of one month (Art. 12(3) GDPR), extendable up to 2 months in complex cases.


8. Data processing

The professional declares being aware that the data generated is processed by the contracting company in its capacity as Controller, in accordance with applicable legislation, in particular Regulation (EU) 2016/679 (GDPR) and the national implementing law of the relevant Member State.

Glivo, the platform developed and operated by Glivo LLC (Wyoming, USA), acts as Processor of the data (Art. 28 GDPR), providing the technological infrastructure, technical security, automatic PII anonymization and retention control, in accordance with the contract entered into with the contracting company.

Glivo LLC has appointed an EU Representative under Art. 27 GDPR.

The data is processed in secure data centers, with international information-security standards. International transfers outside the European Economic Area are safeguarded by the Standard Contractual Clauses of the European Commission (Implementing Decision (EU) 2021/914) and by the applicable supplementary measures, in line with the Schrems II judgment of the CJEU.


9. Term

This agreement enters into force on the date of its signature and remains valid throughout the period in which the professional is engaged with the contracting company and uses the recording and analysis platform.

The withdrawal of consent, where applicable, or the exercise of the right to object (Art. 21 GDPR), shall be formalized in writing to the manager or to the company’s Data Protection Officer, without prejudice to the processing already carried out during the term. The withdrawal of consent or the exercise of objection does not prejudice the professional’s relationship with the company, subject to contractual and legal obligations.

Important: where the basis of processing is the employer’s legitimate interest (and not consent), the professional may exercise the right to object under Art. 21 GDPR, and the company may only continue processing if it demonstrates a legitimate interest that overrides the rights of the worker.


10. Final declaration

I declare, finally, having read and understood in full this agreement, in particular the protections provided in clause 3 (limits on use and worker protection) and the rights provided in clause 7. My questions have been clarified prior to signature.

I freely and consciously accept all conditions described herein.
